CHATEAUNEUF VILLA  & APARTMENT  (Hereinafter referred to as the property).

1. CONTRACT
1.1 Your contract is with Louise Bird (hereinafter referred to as L.B) and is deemed to have been made at her office – 216/16 Domaine Du pre de lac, Chateauneuf de Grasse, France 06740
1.2 The signatory of the booking form is hereafter referred to as the "Client" or "You" and is responsible, on behalf of all members of the party named on the booking form, for all matters relating to the booking.
1.3 In these Booking Conditions, "force majeure" means any event which we or the supplier of the service in question could not, even with all due care, foresee or avoid. Such events include (but are not limited to) war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

2. CONFIRMATION OF BOOKING 
2.1 When You make the booking You must complete a booking form, accepting on behalf of all your party the terms of these booking conditions and pay a booking deposit of 30% of the total cost of the holiday. The booking deposit is non-refundable but may be claimable (in the event of cancellation) on YOUR insurance, subject to terms. Following receipt of the completed booking form and deposit LB will confirm the booking. This is the formal acceptance of the booking.

THE CLIENT IS STRONGLY ADVISED TO ARRANGE A COMPREHENSIVE TRAVEL INSURANCE POLICY WHICH INCLUDES CANCELLATION COVER AND TO HAVE FULL COVER FOR THE PARTYS PERSONAL BELONGINGS, PUBLIC LIABILITY ETC AS THESE ARE NOT COVERED BY THE OWNERS INSURANCE. 

2.2 The balance of the price of your holiday must be paid at least 8 weeks prior to the date of departure. If the balance is not paid on time, we reserve the right to cancel your holiday, retain your booking deposit and apply cancellation charges. Payment in full for bookings made within 8 weeks of the departure date must accompany the booking form.

3. FINANCIAL SECURITY
3.1 the booking deposit and balance of the holiday cost are held in a client account until you return from holiday. This means your money will be refunded if your holiday does not take place for reason of our insolvency.

4. CANCELLATION OR ALTERATION
4.1 the Client may, by notice in writing, cancel his booking at any time. In the event of cancellation after the booking has been confirmed then your deposit will be lost. Cancellation during  the 8 weeks prior to the holiday will mean that the client is liable in full for all charges are payable unless LB is able to re-let the property for the cancelled period. Any expenses or losses incurred in so doing will be deducted from the refundable amount.

4.2 Cancellation must be in writing signed by the person who signed the booking form and will be acknowledged by LB. 

5. ACCOMMODATION 
5.1 the accommodation provided is only for the use of Clients shown on the booking form and sub-letting, sharing or assignment is prohibited.
5.2 The rental period shall commence at 4pm on the first day and finish at 10am on the last day. The Client's co-operation in complying with this request would be greatly appreciated in order that the properties may be prepared for incoming guests.
5.3 A security deposit of £2000 for the main villa or £500 for the apartment for every rental property is required in case of, for example, damage to the property or its contents. This must be paid on arrival by cash, or by CLEARED cheque before arrival (accompanied by a valid cheque guarantee card number). The sum reserved by this clause shall not limit the client's liability to LB who will account to the Client for the security deposit  and refund the balance within two weeks of the end of the rental period after having checked the property and its contents. All breakages must be paid for and be reported to the owners prior to departure in any case
5.4 The rental period will commence at 4PM on the first day and finish at 10am on the last day. The owner shall not be obliged to offer the accommodation before this time and the client shall not be entitled to remain on the property after the time stated. Unless the owner has given written permission, the maximum number of guests must not exceed 10. Additional people joining your party will be charged at £200 per week or part of. Pets are not allowed at the property unless agreed by the owners.


6. DAMAGES
6.1 All damages and breakages will be charged to the Client and must be paid for before vacating the accommodation. The Client undertakes to behave in an orderly fashion and not to disrupt the enjoyment of other Clients or in any way harm the reputation of LB. The holiday of any Client in breach of this clause shall be terminated forthwith and LB shall have no further contractual obligations towards him or her.
6.2 LB reserves the right to make retention from the security deposit to cover additional cleaning costs if the client leaves the property in an unacceptable condition.

The client agrees to be a considerate tenant and take good care of the property and its furniture and equipment and to leave it in a clean and tidy condition at the end of the rental period. This includes thoroughly cleaning all floors, appliances, stripping beds and removing all rubbish/bottles from the property. Although a final clean is included in our prices, in readiness for the next tenants the owner reserves the right to make retention from the security deposit to cover any additional cleaning costs if the client leaves the property in an unacceptable condition. Extra cleaning charges are €25.00 per hour.

7.COMPLAINTS
7.1 If, during the course of the holiday the Client has reasons for complaint or dissatisfaction, he should contact LB as soon as possible in order that immediate remedial action may be taken. 
7.2 Any complaints after the holiday should be made in writing to LB within 28 days of the end of the holiday.

8. LIABILITY 
8.1 LB agrees to use all reasonable Endeavour’s to provide the booked holiday as described in the advert, but will not be responsible if, having used all reasonable endeavour’s, it is unable to do so.
8.2 LB accepts no liability (except where LB is proved not to have used due diligence) for any loss or damage incurred or suffered by any Client in connection with any mode of transport in any way arising out of the holiday.
8.3 Whilst LB uses due diligence in its efforts to ensure that all descriptions of, or any information in relation to, holidays supplied to Clients are accurate, it shall not be liable in the event that an aspect of the holiday fails to comply with any description of information even if the Client specifically relied on that particular aspect in choosing or booking the holiday, provided LB has used due diligence.
8.4 LB shall not be liable for any loss or damage arising in connection with the holiday caused by any matter outside the reasonable control of LB including (but not limited to) Acts of God, war, civil disturbance, strikes or other industrial action, acts of government, failure of public services (e.g. water and electricity), failure of mechanical equipment such as boilers, electrical equipment or pool machinery, although LB will use due diligence to remedy such failures.
8.5 Under no circumstances shall LB's liability to the Client exceed the amount paid by the Client to LB for the rental period.

This contract shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England.
